1. GENERAL
1.1 Applicability

These terms and conditions apply to the “Miffy Giveaway” of 2024, organized by the Van Gogh Museum in collaboration with Just Dutch.
1.1.2
The information about and conditions of the “Miffy Giveaway” can be found on the website https://www.vangoghmuseumshop.com/miffy .
1.1.3
Van Gogh Museum is a trade name of the Van Gogh Museum Foundation, located at Museumplein 6, 1071 DJ Amsterdam.
1.1.4
By participating in the giveaway, the participant and if the participant is under the age of 18, their parent/guardian agrees to these terms and conditions.
2. “MIFFY GIVEAWAY”
2.1 Specification
2.1.1
By submitting the entrance form, you are entering the giveaway and you accept these terms and conditions of entry.
2.1.2
By participating in this giveaway, you have a chance to win a miffy XL 55 cm Sunflowers worth € 249.95 RRP.
The prize will be shipped to the winner free of charge.
2.1.3
Participation takes place by submitting a completed entry form, which can be found on the website of the webstore. On this entry form, the participant provides an original answer to the question: “ Tell us why you would like to win the miffy XL?”.
2.1.4
The entry period for the giveaway runs from Friday 15 March 2024 to Tuesday 30 April 2024, after which participation is no longer possible.
2.1.5
From the entries received within the period specified in Article 2.1.3, a selection will be made by a jury determined by the Van Gogh Museum on the basis of the best and most original answer.
2.1.6
The winner will be selected by 14 May 2024 at the latest and will be contacted by email.
Should the Van Gogh Museum not be able to contact the prize winner within 30 days after the giveaway, the prize winner is no longer eligible.
2.1.7
It is not possible to exchange the prize, as referred to in Article 2.1.2, for cash or an alternative prize.
2.2 Participation
2.2.1
Any natural person can participate in the giveaway taking into account articles 2.2.2, 2.2.3 and 2.2.4.
2.2.2
Employees of the Van Gogh Museum are not allowed to participate in this giveaway.
2.2.3
Participation by minors is only permitted with the express consent of parents or guardians, with special observance of articles 2.2.1, 2.2.3 and 2.2.4.
3. LIABILITY
3.1
Under no circumstances can the Van Gogh Museum be held liable for:
a. incorrect or late submission of entry forms;
b. unclear or incorrect wording of the answer given to the question: “ Tell us why you would like to win the miffy XL?” by participant;
c. technical issues that may affect electronic communications;
d. the submission of incorrect or incomplete data by the participant.
3.2
Participation is at the participant's own risk and, if applicable, his/her parents/guardian. The participant and his/her parents/guardian are responsible for the correct input and transmission of data. The Van Gogh Museum does not guarantee that the internet and/or other networks provide optimal use and access and/or that its website will function without errors and that all submissions will be received correctly and completely.
3.3
The Van Gogh Museum is not liable for any damage resulting from participation in the “Miffy Giveaway” of 2024. Changes and typing errors are reserved.
4. PERSONAL DATA
4.1
By participating in this giveaway, entrants consent to the submitted personal data being processed.
4.2
The personal data of all entries processed consists of: first and last name, e-mail address and personal motivation.
For the winner of the giveaway, his address details will also be processed for the purpose stated in Article 4.3.
The winner’s first name, place of residence and the winning answer will also be featured on the giveaway landing page in our webstore.
4.3
The above-mentioned personal data is used to be able to select a winner from all participants and to be able to contact the winner and deliver his prize.
4.4
The personal data referred to in this article will be stored for a maximum of two months after the end date of the “Miffy Giveaway”.
4.5
By participating in this giveaway you consent, and if you are younger than 18 years old your parent/guardian or other legal representative, to the submitted personal data being processed.

5. INTELLECTUAL PROPERTY RIGHTS
5.1
The participant declares to be the creator and/or rightful owner of the entry he/she has submitted. The participant indemnifies the Van Gogh Museum against all claims from third parties regarding (alleged) copyright infringement with regard to the submitted entry, namely your motivation.
5.2
By submitting his/her entry regarding a copyrighted work, the participant grants the Van Gogh Museum an unlimited, exclusive and worldwide license to use, without compensation, and to make the submitted motivation public and reproduce it at all times. external and internal communication channels of the Van Gogh Museum, including but not limited to the official website of the Van Gogh Museum webshop and also for use in internal and external communication to third parties, such as the official website(s), social media and other channels.
5.3
This license is for an indefinite period.
6. FINAL PROVISIONS
6.1 Reservation
The Van Gogh Museum retains the right, at all times and without giving prior or subsequent notice, to:
a) exclude participants from participating in the ‘Miffy Giveaway’, should the museum be of the opinion that the participant is misusing the giveaway, not acting in accordance with these terms & conditions, acting fraudulently and/or attempting to illegitimately influence the selection;
b) make changes or improvements to the website or restrict/remove access to the website;
c) prematurely terminate these terms & conditions, other terms & conditions or the giveaway itself;
d) insofar as the museum deems such action to be appropriate.
6.2 Questions and complaints
The Van Gogh Museum will not enter into correspondence regarding the result of the giveaway.

6.3 Governing law and choice of forum
6.3.1
In the organisation of this giveaway, the Van Gogh Museum acts in accordance with the Gedragscode Promotionele Kansspelen (Code of Conduct for Promotional Games of Chance).
6.3.2
Dutch law applies to the “Miffy Giveaway” of 2024 and the conditions. Disputes will only be submitted to the competent court in Amsterdam.
